Some important legal questions that will need to be answered.
- This (alleged) video is on VHS. This means it's likely at least 15 years old. What is the statue of limitations for this crime - sex with a minor, so statutory rape - in the state of Illinois?
- This man has been tried for practically the identical thing (having sex on tape with a minor) and was found innocent. To what extent does the concept of "double jeopardy" come into play?
- Certain pieces of proof were barred from R. Kelly's trial because of the way they were obtained. The first move of Kelly's defense team will be to ascertain 1) how exactly this video was obtained (so they can move to have this video suppressed from the trial, and causing an immediate mistrial before it even starts - so this would be at a judicial hearing before the trial) 2) who the person was that leaked the video (so they can discredit this person immediately and influence potential jurors)
- Every person in the United States of America has right to a fair trial (at least that's the rumor lol). There was a hit documentary released called "Surviving R. Kelly". Is there anybody - even on the prosecutor's team - that can say that R. Kelly can have a fair trial and that they can find actual people who have not already formed an opinion on whether R. Kelly is guilty or not to sit on the jury? This goes both ways: R. Kelly is a super celebrity with a career spanning decades. Who has NOT heard an R. Kelly song?
- THE KEY QUESTION: they have a video, they have identified R. Kelly. Besides the question if they can make a positive ID of R. Kelly, the real question is: can they identify the girl in the video and more importantly: will she be willing to testify?
