Do you know if you can write up some kind of personal roomate agreement that can legally hold roomate not on a lease to pay their part if it is stated and signed.

Me and my homeboy trying to get a spot together but a misdemanor theft charge from 5 years ago has apartment complexes turning him down. altho he was able to get jobs and two reputable companies that deal with personal property and money handling. So he can't get on lease but apartment complex is willing to put me as leasehlolder and let him still move in. I trust dude we go way back but anything is possible.

Let me know coli fam.

Well, basically, the apartment is letting you put your head on the chopping block if he bails.
What does this mean? You can write up a legal agreement/contract and have him sign it. But if he skips out of town, you still owe the apartment complex his cut of the rent, you would have to hunt him down for money, and you would have to sue him in small claims court for money he owes. You would use the contract he signed as proof.
And if you don't pay the apartment complex his cut of the rent, they can go after you, not your friend. They can evict you. They can sue you. Whatever contract you have him sign won't mean anything to them because you are the leaseholder.

THE THING IS IF SUB LEASING IS AGAINST THE LEASE AGREEMENT WITH THE COMPLEX HIS FRIEND WON'T BE LIABLE FOR THE PERSONAL CONTRACT. YOU CAN'T KNOWINGLY ENTER A CONTRACT THAT VOIDS ANOTHER. USUALLY THEY VOID THE SECOND CONTRACT AND THE ORIGINAL CONTRACT HOLDER CAN SUE YOU FOR BREACH.

So basically, you are kind of the sugar daddy and your friend is the baby momma. It's going to be a contract by word.

edit info based on the current lease
a sub-let/sub lease agreement
also get the doc notarized
also look at laws in the city the apartments in
Sample sub-let/sub lease doc->www.biggerpockets.com/forms/blankrentalagreementbp.doc

could be a dicey situation, if the sub-let/sub-lease is not formulated well...
