No, simply because law enforcement and the judicial system due to their racial bias will try and make Black people and other non-white ethnic groups the prime image and target of such policies.

I don't advocate being a part of a gang but, nobody should be jailed just on that basis unless they're found committing an act of detrimental crime.

A gang constitute of group of individuals largely dependent on that activity. Ever heard of hobbies? You can have gangs of musicians, artists, comedians, business men, etc. The commonality being recreational fun.

Hobbyists aren't gangs, because they lack the criminal element, they are groups

You can be in a gang, and a law abiding citizen, without actively engaging in criminal activity. Individuals have a presumption of innocence, even in groups. Unless someone is actively breaking the law, the state cannot assume they are guilty. Even if they caught in the act, the State needs to prove in in court.

In Australia it's illegal to show gang affiliation in public ie. tattoos, clothing, jewelry but there are still thousands of biker gang members.

Making it illegal won't stop gangs.
