This is where it gets tricky in my opinion. There are actual predators out her. Men who actually force themselves on to women. Men who prey on women. To lump those creeps in, with guys who drink with women, only to have those same women claim "rape" when they consented to A) accompanying the person , B) drinking with said person and C) going home with a person is wrong.
Period.
It's a lose-lose for men. You drink with a girl, you have sex? She can claim rape. Even if she threw herself on you.
It's like people on the internet forget how the real world works and how real experiences work. Only on the Internet does somehow "ask for consent" Everytime they have sex. It doesn't work like that.
There are women who would look at a man sideways if she's clearly being forward with you and you still "ask for consent".
Also, what dos this mean for the women who give consent then "don't remember" after due to drinking
The thing is, anyone who has spent a significant time on a college campus knows that fellow college student (males) prey on drunk girls (like the guy who had the girl behind the dumpster). On college campuses, most predators aren't jumping out of bushes; it's usually the guy in the corner (like that swimmer) wait to see a girl stumbling around.
In regard to intoxication, just like a contract might not be enforceable if one party knows that the other is intoxicated (because judgement/capacity is impaired), courts have created the same rules for the definition of rape. I'm fine with that definition unless both people are shyt faced because at that point, who raped who...
Unfortunately, this one of those situations where you have to protect yourself as a man (just like I think women need to protect themselves again pregnancy since they will be faced with the repercussions). One of the best ways to prevent this is to not have sex with people you literally just met. If anything, Nate is the one who set his boys up for a charge. It probably wouldn't have even turned into anything if sex had remained with just Nate given that she didn't even really seem to know the other guys.
Finally,yY'all can be silly if you want to, but I'm going to teach my sons how to protect themselves against shyt like this. Other than Penn State who obviously doesn't give a damn, even about child molestation, many colleges really care about sexual assault. And with the attention that rape has been getting lately (because of light sentencing), people will only begin to care more.
