Court hearing: Clare wants to keep Geragos – Avenatti fired

The Curcio hearing today was largely uneventful.

The upshot is that Clare Bronfman wants to keep Mark Geragos as her attorney – despite the possibility that he might be in trouble for his role in the Nike extortion case as is his partner, Michael Avenatti.

As far as Avenatti is concerned, he will not be representing Clare. Over and out.

The sum total of Avenatti’s representation, the court was told, was to help secure a “Third Party Cooperation Agreement” whereby Clare could “buy” less prison time in a plea deal through Avenatti getting the government someone who has valuable information for them to use on another case.

This is one way the wealthy can purchase justice rather than have to pay the full price for their crimes like poor people do.

Avenatti met with the feds – to offer to bring someone in for the feds to use – possibly the Nike whistleblower – in return for the feds giving Clare a better plea deal.

I can imagine Clare paying big bucks to Avenatti for this if he could pull it off – and I can see Avenatti getting most of the money and giving the actual whistleblower a pittance (In the attempted extortion of Nike, Avenattit and Geragos were going to split $21-$23 million – and the whistleblower was going to get $1 million less whatever percentage he had to pay to Avenatti).

It was also revealed in a court filing that Clare has other attorneys, most notably John Sandweg of Arizona and a jury consultant from Geragos’ office.

In addition, it was revealed that Avenatti was retained by Clare in a civil matter – evidently concerning myself. More on that later.

It was uneventful, kind of technical today. Judge Garaufis cited examples of how attorney conflicts of interest may or may not occur.

At the hearing was Benjamin Brafman [Geragos’ criminal attorney concerning his own involvement in the Nike extortion case]. Marc Agnifilo, [Keith Raniere’s attorney] was also at the hearing.

Judge Garaufis asked about Clare’s health. She was looking better today.

The judge said he wanted to make sure she was well because he was concerned for her, and also because he wanted to make sure she was able to absorb everything discussed at the Curcio hearing.

Bronfman said she wanted to keep Geragos as her lawyer and he quipped, “It is good to have a client who is that satisfied with me.”

Geragos is charismatic. I could see why he became so successful.

The judge asked Clare if she really did find Geragos from an internet search and she said yes, but she also indicated that prior to her being in the market for another lawyer, she did have a conversation with Teny Geragos [one of Keith Raniere’s attorneys and Mark Geragos’ daughter ] and she spoke about her father.

The alleged co-conspirator in the extortion case against celebrity lawyer Michael Avenatti is reportedly Mark Geragos, Clare Bronfman’s lead attorney.

While Geragos, 61, was not named in the criminal complaint against Avenatti, prosecutors say in court papers that an unnamed attorney joined Avenatti in demanding that Nike pay millions of dollars, or risk being embarrassed by a scandal involving its sponsorship of an amateur basketball team.

It is not known if Geragos has been charged with a crime.

A source knowledgeable about the case told the AP that the co-conspirator was Geragos.

The Wall Street Journal also reported that two sources said the co-conspirator, referred to in the indictment as “CC-1”, a California attorney “known for representation of celebrity and public figure clients,” is Geragos.

It is not known whether Geragos is cooperating with investigators.

According to reports regarding the indictment, Avenatti and a co-conspirator [Geragos] “allegedly threatened to hold a news conference on the eve of Nike’s quarterly earnings call and the start of the National Collegiate Athletic Association tournament to publicize alleged misconduct and maximize the damage such information could inflict on the company.”
If Nike’s lawyers wanted them to remain quiet, Avenatti allegedly said that he and Geragos would need to be paid between $15 million and $25 million to conduct an “internal investigation” into the athletic apparel company.

Avenatti said they would agree to a flat $22.5 million payment from Nike if the company did not want to keep them on retainer. $1.5 million of that amount was supposedly going to be paid to one of Avenatti’s clients.

Avenatti, who previously represented adult-film actress Stormy Daniels, was arrested Monday in the Southern District of NY – and charged in two federal cases with wire fraud, bank fraud and attempting to extort more than $20 million from Nike Inc.

Geragos was also recently hired as a member of the legal defense team of Jussie Smollett, the Empire actor who has been charged over allegedly staging a fake hate crime against himself in February. He’s also currently a lawyer for Colin Kaepernick.

Geragos’ previous clients have included Michael Jackson and Chris Brown.

Last month, Clare Bronfman retained Geragos as her new lead attorney. A source familiar with the case said Geragos likely received a $3 million up-front retainer from Bronfman.

Geragos and Avenatti allegedly met with Nike lawyers on March 19 to make their demands, and the Boies Schiller law firm subsequently recorded another conversation with Avenatti at the request of prosecutors.

Just prior to his arrest, Avenatti tweeted he would be “holding a press conference to disclose a major high school/college basketball scandal perpetrated by Nike”.

CNN said today that Geragos, who has been a frequent commentator for CNN, is no longer a contributor for the network. Geragos did not respond to requests for comments.

How this will impact Geragos’s representation of Clare Bronfman remains to be seen. If he is charged, he may have to resign from the case.

In any event, Geragos will undoubtedly be distracted and certainly will not be able to focus completely on Bronfman’s defense as the days dwindle down heading toward the start of the Nxivm trial that is currently scheduled to begin with the jury selection process two weeks from today.

Some observers felt that the entry of Geragos as an attorney for Clare Bronfman signaled her departure from the joint defense arrangement that was largely orchestrated by Keith Raniere’s lead attorney, Marc Agnifilo.

Geragos was expected to be back in court – along with all the other defense attorneys and the five remaining defendants in the NXIVM/ESP case – at the April 4th Status Conference.

Allison Mack Asks For 30-Day Delay Of Trial So She Can Conclude Plea Deal- Judge Denies Request

Judge Garaufis has denied Allison Mack’s motion for a 30-day continuance for the trial that is currently slated to start on April 29th.

No reason was given for the denial.

And the pressure mounts…

Allison Mack wants to get a seat on the Plea Deal Bus…

In their latest filing in the case, Mack’s attorneys, William F. McGovern and Sean S. Buckley, have asked the court to postpone the start of the trial from April 29th to May 29th.

The reason they cite for the request is that “Ms. Mack actively is engaged in negotiations with the government regarding a potential pretrial resolution of her case, and the additional time will allow the parties to conclude those negotiations without prejudicing their ability to prepare for trial”.

Mack’s attorneys noted that the request was made “with the consent of the government” – which drew an immediate response from Marc Agnifilo, the lead attorney for Keith Raniere.

In a one-paragraph letter, Agnifilo writes:

Dear Judge Garaufis:

Knowing that Your Honor has 500 jurors coming in for jury selection on April 8, 2019 and April 9, 2019, the government remarkably consents to a 30-day adjournment of the trial to conduct plea negotiations. (Dkt. 481.) As Your Honor reconfirmed as recently as 30 minutes ago, this trial is going forward with jury selection on April 8, 2019. We thank the Court for setting the firm trial date that has existed for months now, and we look forward to abiding by the Court’s trial date.

The latest filing on behalf of Mack confirms that she is seeking to avoid going to trial on charges that, in the worst case, could see her ending up in prison for the rest of her life.

Two of her co-defendants – Nancy Salzman and Lauren Salzman – have already pleaded guilty in the case.

Nancy pleaded to one count of Racketeering Conspiracy – and Lauren pleaded guilty to one count of Racketeering and one count of Racketeering Conspiracy.

Given how plea deals usually work in cases involving multiple defendants, it is expected that Mack will have to plead to at least two counts in order to avoid going to trial.

Per the second superseding indictment, Mack is facing the following charges:
• Count One: Racketeering Conspiracy

• Count Two: Racketeering
(a) Racketeering Act Ten: State Law Extortion
(b) Racketeering Act Twelve: Sex Trafficking Of Jane Doe 5 and Forced Labor Of Jane Doe 5

• Count Six: Forced Labor Conspiracy

• Count Seven: Wire Fraud

• Count Eight: Sex Trafficking Conspiracy

• Count Nine: Sex Trafficking Regarding Jane Doe 5

• Count Ten: Attempted Sex Trafficking Regarding Jane Doe 8

Lawyers familiar with the case have opined that Mack may have to plead to at least one sex-related charge in order to get any sort of plea deal.

If that’s the case, then it’s quite possible that Mack could end up being a registered sex offender for the rest of her life.

FIRST UPDATE

Mack was the first of the defendants in the case who was supposedly considering a plea deal. But that occurred very early in the case – and was viewed by many as a ploy to ensure that she was allowed to remain out on bond as she awaited trial.

As noted in an earlier post, Clare Bronfman has also been working on a plea deal.

But hers apparently involved a lame-brained attempt on the part of her lead attorney, Mark Geragos – and her “consultant”, Michael Avenatti – to trade off information that Avenatti had about alleged illegal activities on the part of the Nike company to get a sweetheart deal for Clare.

Whether the prosecution will engage in any further negotiations with Clare is uncertain.

But, unless she gets her skinny ass in gear, she will likely be getting a worse deal than Allison gets.

Thus far, it appears that Keith Raniere and Kathy Russell are the only two defendants that are not actively involved in plea deal negotiations.

Unfortunately for Kathy, it’s beginning to look like she’s going to end playing the part of Gilligan while Raniere plays the part of The Skipper in this version of Gilligan’s Island.

Interesting.

It seems Avenatti/Geragos were double dealing and bit off too much. Seems like they were only needing to trade off info to the feds and not cash out, the funny thing is that they might have gotten away with it if they didn't ask for so much.. people should be asking where Avenatti got his info from again LIKE I STATED BEFORE.

Raniere is a high up trainer and the Bronfman family has been heavily influential towards the success of the Clinton's for DECADES. Raniere and Mack can be set adrift but Clare is too valuable but goddamn if this isn't a collosal fukk up..someone might get clipped over this.
