That's doesn't add up on the sentencing guidelines...maybe he only profited $80k but the fraud must have been in the $1M+ get 40 months per guidelines. Maybe it was stated he had a major role rather than a minor role?

If his sentence is outside of the recommended federal guidelines he can appeal even if he took a plea.
