But that not the same thing because it would have been launched in other countries by then and the NDA is lifted. But If someone would have had a PS4 2 weeks ago while the nda is still in place he would have been banned.

He is not obligated to follow rules of a NDA or some embargo because he never signed no dotted line. He most likely got banned because he wasn't on some "whitelist" or whatever or some suit probably had plans for reveals and he wasn't in it. I highly doubt it has to do with some NDA.

Yup which is what I said but Sony or more specifically Yosp on twitter said no one will get banned playing PS4 early. Quite frankly I've never heard of anyone getting banned playing games early on PS3 online. I played TLOU, UC3, LBP2 and a few other titles early and nothing ever happened. Hell even guys who got on PS3 through illegitimate means on CFW PS3's were fine after updating and restoring back to OFW.

Yes true the buyer is not bound by the NDA but MS is. A contract is a 2 way street. If MS allows him to continue to put out info that still behind a NDA contract they will get sued by the companies that signed the NDA for not mitigated the leak. That what a NDA does.

And replied to this already earlier in this thread. If the PS4 was shipped early and was still under NDA yes they would ban his consoles.

this kid didn't just get his xbox early and play some games. he was all over twitter and youtube blowing up the spot. it doesn't sound like a perma-ban anyway. he said he can still play SP games, so it's not like they bricked his console
