The Supreme Court gutted the Voting Rights Act of 1965 a few years ago - if anyone in this thread thinks it was anything else than pure racism on the part of the judiciary in this case.

The Civil Rights Act was going to be shot down due to a circuit split in the next few years anyway.

Can anyone explain what actually happened in terms of the Supreme Court decision and what he had to prove in the lower courts? How he should have approached the case?

All I got from you all is: he fukked up with the wording. Which is what's been said for months.

Who said he shouldn't have sued? The stakes changed and once the but-for causation was challenged he threw a hail mary anyways-- our expense. You got at least one poster admitting it was a lost cause at that point.

Comcast was racist enough to block him, threaten our civil rights, trample them, and he still took the bag and got his channels added to their line up... They're making bread together now. This is something that could affect you far more than it ever would him. Or Comcast. Or the SC Justices.

What Byron was willing to settle for, before and after the case ruling was substantially different.

The lower courts ruled in favor of byron allen. Comcast decided to appeal to the supreme court. Why would settle for less when the lower court already ruled in his favor? This is solely on comcast for appealing using their racist reasoning. Byron wasnt the one filing an appeal cause he already had a won the initial case.

There was a lot of pressure on comcast to settle as well. Many celebrities like diddy were talking boycotts if comcast continued. And just as Black folks were getting on code there was a well oiled smear campaign leading up to the SC decision on Byron allen which included Tariq nasheed, judge joe brown and other black folks. People who suspiciously never spoke on byron before or after the case for that matter had a lot of things to say and did interview rounds on white networks right before the SC case. They muddied the waters just enough to take the heat off comcast so it was a successful campaign.

I never once said there wasn't any merit. Idk where y'all are getting that from. I believe he was racially discriminated against. Comcast's tactics expose that even more, if anything. But if it's gonna come down to one man getting a few more channels or protections for 40 million black people remaining untouched, imma pick the latter all day. Find another angle to your argument, take the settlement (too late, he already did) I don't care. Just don't gamble with protections for the rest of us when we have nothing to do with your lawsuit, nothing to gain from it, and a substantial amount to lose. I can't make it any clearer than that :yeshrug:


That's fine.... but what it sounds like you're saying to me is, let me settle for the lesser impact of racist discrimination to my own detriment........ even if my merit warrant what is owed....... nobody black really wins in this situation.....

The article in the OP is from a lawyer but their input would be appreciated. It's not s matter of wording though. The way I see it, he gambled on a 150 yr old Civil Rights Act... and still pretty much got what he wanted while the rest of us are now lacking. Comcast showed just how cutthroat they can get about this shyt and he showed his teeth right back and said I don't give a fukk. This wasn't some mass lawsuit fighting for the people. It was one man, whose a billionaire, who was gonna be fine regardless. He just wants more broadcast rights. The muhfukka "lost" and still won, where da hell they do that at? :dahell: We didn't even have any skin in the game and yet we were ones holding up the card table.

:usure: Comcast would have been just fine not carrying channels people weren't going to watch anyway. Not sure where the imaginary pressure was going to come from or what leverage black folks could have used against them.

I'm saying we were collateral on both sides. Byron Allen went thru like three cases before this was brought to the Supreme Court. The Civil Rights Act wasn't targeted until HE introduced it. No that's not his fault and no that doesn't make it right, but what he does after the fact is the shyt he's responsible for.


What exactly is your position again? Beyond dic-- nah...I been civil this whole thread and Imma keep it that way :mjgrin:

What protection are you referring too? If the supreme court shot it down then it was never worth a damn anyway. It would have been challenged eventually.. if not comcast, then someone else. Discrimination cases like this have always been extremely hard to prove and win. This aint new. Most companies settle cause of bad PR. The silver lining is black folks should be pushing for stronger laws and protections to be enacted and this ruling could be the catalyst for that.
