I'm not a criminal lawyer, but I guess it would depend on how things unfolded. If she hit him and ran into the other room, then you've got a point. But if he reacted immediately, which is what people often do when they are being viciously assaulted by a mentally unstable person who has thrown deadly objects at them in the past, he would be in the right i would imagine.
