I don't think they will, thats why they threw him out in this game that was already over and he had already fouled out of. They can say he was ejected for throwing the mouthpiece and leave it at that. Its the same as the league giving Draymond a flagrant 1 for the nut kick so they could keep him in the game, then retroactively upgrade it to a flagrant 2 and not suspend him for the next game.
