Eh, everyone deserves proper representation and an opportunity to cross-examine witnesses. It gets messy at times but imagine the alternative.
The onus is on the prosecutor to prove guilt beyond a reasonable doubt. Should be a slam dunk with the tape, regardless of any mitigations and "well yeah but"s by the defense

before anyone jumps on this, I have to agree on principle. I wouldn't do it, but someone has to do it. and as one commentator pointed out, a guilty verdict will stand much stronger if there was a vigorous defense
