the judge is giving a thin line for there to be a mistrial. all the prosecution's witness needs to do is mention the late lab results and bam like that, mistrial. nah. the witness can fucck this up by accident.

nah, he should be well prepared. as we speak, they're in the back telling him to wipe that shyt from his brain. he can't fukk it up by accident.

some of this stuff we gotta look at objectively. if that was a breh on trial we'd all be calling this newly discovered overnight evidence some funny shyt.

and this case ain't about the evidence anyway. nobody legitimately thinks he died from carbon monoxide. so, one way of looking at it is, the defense isnt getting an easy out on appeal.

What happen?
Judge won't allow new evidence that proves George Floyd had normal carbon monoxide levels. If Blackwell, or the witness, likely Tobin again, accidentally mention or allude to test results the judge will rule for a mistrial.

But Tobin is allowed to give his opinion on carbon monoxide and it's relation in terms of proximity and environment to George Floyd. So he can make the case that it's highly unlikely there was any Carbon monoxide intoxication.

The judge said if Dr Tobin brought up blood saturation (or something like that) during his questioning, it could be called a mistrial.

Why would the judge allow for new evidence? Seems deliberate.. but like I said burn that city to the fukkin ground

The state medical examiner office somehow 'forgot' to turn over this carbon monoxide report with other evidence in February. Dr Baker, just heard about the carbon monoxide theory yesterday and remembered, we did a carbon monoxide report. Sent the report to the prosecution and defense around 8AM. Defense is saying if judge allows it he'll apply for a mistrial. Judge is saying that clearly something went wrong with the evidence collection and the medical examiner's office should change their operating procedure, nevertheless he ruled that the prosecution had ample time.

the defense can try to trick tobin into mentioning the new evidence. and tobin is old so i fear he might slip up. the prosecution gotta be ready to push that "OBJECTION!!!!!" button soon as the defense hints at going there.
