The devil is in the 2nd Heaven. He even had access to be able to present himself to the Lord in Job's time. I don't know how much access he has now, but the serpent is not in Hell like many have been led to believe. He gets thrown down to Earth when the saints are taken from the earth in the rapture. Then he gets bound in Hell when the Lord comes back to earth.
