Prosecution recommendation is pure formality/Save Face. It's not as if the judge doesn't know you're still trying to punish the defendant for the guilty verdict you couldn't get in court.
The judge has pretty much played ball with the prosecution for most of this case. It's time for the other side to get a favorable ruling
