I took some business law classes in college and most law suits fall under duty of care ...

an example would be if i walk in to a store and the roof collapses and i am injured i can sue because

the store owner had a duty of care of properly maintaining the store and making sure the roof would not collapse ;;; there duty of care can be void if let say a part of the store is closed off for repair and there a warning and i go and sneek in ... the store duty of care is voided...

duty of care tends to fall in line for accidents and malpractice

in sexual assault case "duty of care" might fall in institutions that don't properly vet there employees;
like hiring a rapist as a school teacher and a family sues the school district for not doing a background check ...

there a lot of lawyer trying to broadly stretch duty of care and its going to break at some point

if lets say what she says is true .. duty of care would fall on Vh-1 and not Game and with out a police report and investigation they would realistically dismiss this case in appeal
