All of his Bubba the Love Sponge appearances were well before the tape came out when they were friendsI haven't really been following that close, just reading this thread and watched that youtube clip.
But the law, or just the amount of damages, might be dependent on whether or not Gawker actually did any *harm* to Terry Bollea.
This is a TORT case, not a CRIMINAL case.
It might seem bizarre, but it makes sense for them to question him about the Bubba Sponge interview and his comments on his knob-size. If Hogan is claiming that he suffered due to the leak of the type....he's almost certainly talking about a loss in reputation/public opinion/being shamed/etc. A solid counter-argument to that would be to bring up instances of him *openly* talking about his body/sex acts in public. Gawker's lawyers are saying "Oh, you claim to be so embarrassed by the sex tape...well we have an interview of you talking about having a 10 incher".
Terry was only talking about his...er...Hulk's penis. So, I don't think that the jury is going to buy this defense from Gawker. But I understand the reasoning behind it. But imagine if this were say...a pornstar? Or a nude model? Or someone that used to post their own nudes online? This case would look a lot different, and I imagine that that defense would be a lot more valid.
This shyt is pure and utter fukkery...but there's a reason for them to question him on that interview. And Hulk is actually smart to highlight that he was only speaking in character.
At least that's what I think is going on, like I said, I haven't really live streamed or anything.
I'm actually perplexed at some of the other things though. I've no clue what Andre The Giant has to do with this. Lawyers ARE allowed to paint a setting/emotional state though. Those comments might just be responses to lead in questions, and things that they aren't really focused on.
