Had to be, only thing that gives me hesitation is that it stated he had his seat belt on. But that black box info is telling. He basically floored the gas into oncoming traffic. Probably had a late reconsidering and swerved into the tree. Dude had an empty bottle of pills and someone at the hotel he left said he was driving like a mad-man leaving the parking lot.
