Probably because they went into it thinking "There is video proof that this guy killed flat out ran over our son and killed him. Video proof that the car in front of Tony was cognizant and alert enough not to run over our son. Video proof of Tony Stewart being a hot head. Video proof of Tony saying in response to an argument with another driver "I will run his ass over". There is all this evidence. Yeah our son getting out of the car was stupid. But you know what, plenty of other drivers have gotten out of there cars before and didn't get ran over and killed. Tony Stewart himself has gotten out of his car during a live race multiple times in his life and he didn't get ran over and killed. This is an easy case we will get justice."
And then they get hit with the "He had weed in his system."
"But Tony ran our son over it is on tape."
"Sorry maam your son had weed in his system."
"But they say they were arguing about something before it all happened."

"But Tony has a history with being overly aggressive during races, wrecking other races cars, and threatening to run them over."
