Let me clarify, most restaurants or businesses (that have valets) are indemnified for these types of losses through their business owners policies with specific endorsements.

any lawyer will bring up that it is known knowledge them type cars do that when you rev the engine carelessly.
gross negligence is carelessness in a serious way.
i dont think insurance will take that bullet on the whole $$ lost.
someone else has to pay.. either they pay out a little or nothing.
i doubt that is covered under insurance. its not an accident.

Look at it this way, the valet is the one who fukked the car up by fukking off with it rather than doing his job. It would be negligence if the owner himself was revving it like that, but he didn't. It'd be the same thing if you brought your car to an auto shop and someone fukked around and destroyed your whip, the business would be held liable, much like whomever that valet was working for. That company's gonna have to pay for that car cuz their employee fukked it up.

They have Commercial Auto policies that provide coverage for businesses that specifically have services like this. Their insurance will cover it but I wouldn't be surprised if they terminate them right after paying out for the damages

but the valet driver didnt do this moving the car. he did it on his own time and took the car for a "spin"
i dont see how any insurance would allow that claim through without trying to bring in a lawyer to go after the company to pay.
i think because the valet driver wasnt working while driving it, it will be twisted.

but who knows... maybe some stupid insurance company wiil eat that bullet rather than see it was gross negligence. who knows

the insurance will pay, if your car is stolen and trashed even if you left your door open your insurance will pay, but your premiums will be high as hell and they may terminate your policy.

You're probably right.

If I was an adjuster working this, I'd find ANY REASON to NOT pay a claim and I'd probably find it. It's a toss up but either insurance will eat or that restaurant will get sued to death depending on additional circumstances.
