Idk the legalities of the whole situation but this was before all the mixtape sampling thing started just a few years ago with frank ocean and mac miller so idk.

But back then to the best of my knowledge ppl could still sample for free on mixtapes.

Even if it was illegal, it probably isnt worth it to sue Wale (at that time), they would have lost more in legal fees.
