This case will go before a JURY. The deciding factor of wether he's found guilty or not of attempted murder is wether or not they believe this man struggled for the gun and was shot along with Banga in the struggle, retaliating after reasonable belief that his life was in immediate danger or not. THAT'S IT.

Time, sentencing, reduced charges, all that comes after.
