It's not self-defense, whoever said crime of passion is correct. This is Texas, a state known for a large number of crimes of passion and it reminds me of that other Texas case not to long ago where ole boy killed the guy who he caught molesting his daughter. Grand jury didn't indict him because they claimed he was acting in defense of a third person, his daughter, when he killed the man:

HOWEVER if they had indicted him he more than likely would have gotten off on a crime of passion plea. It will be interesting to see whether or not this guy gets charged or not....oh and even if the crime of passion plea works it's not an automatic dismissal of charges, the jury could just find him guilty of a lesser charge with lesser jail time.

Honestly If you have HIV there should e a government issue branding below the waist.
