Would making affirmative action lineage based instead of race help it stand up to legal challenges?

Affirmative action is currently being challenged in the supreme court and most people believe that it will be defeated. I'm wondering if it was lineage biased instead of race based if it would stand up better in court? Coli lawyers feel free to comment.
