There's state guidelines in Florida that may be different in CA, but pretty sure the state can retry at least 3x. But, they usually don't go more than twice. He does not get to go home yet.

The reason he would plea is because they will have info on how many jurors were between him and life in prison. Say it was only 2 jurors, who just wouldn't listen to reason. 10-2 jury verdict means he came within 2 idiots of doing life in prison. Would you want to risk your life on running that again? They will pick a new jury.

Now that both sides have played one round, they know the case better, both sides are bruised, and they may want to just resolve this. It's pretty common.

No my man's had a mistrial on a murder he didn't do they didn't let him go and he was found guilty at the second trail got 68 years.
Goddamn! Was he offered a lesser plea deal and decided to take his changes and ended up blowing trial?

Now that I’m well versed in the criminal justice system, even if your man’s was innocent, his defense team knew what the jury verdict count was on the first trial and probably should have just taken the plea deal. They probably knew that taking it to trial the second time wasn’t in his favor, but I get it, he in his heart knew he was innocent so that was his story and he was sticking to it. Me, I would have taken the plea :manny: Do you know what they offered him?

Don't remember at the time of the trail I was locked up myself. Crazy part is the nikka that did it locked up for murder right now. Could have just took his time then:unimpressed:

This isn't "Walking away", it just buys each side more time to evaluate the cae, he isn't about to be roaming the streets.

Melly is going back into the pokey. They will re-arrest him and get the retrial in motion. If the death penalty is on the table, I highly doubt the prosecution will bargain with him unless he cops to 25 to life.

They will try to stack the jury and drive home the phone evidence. Melly is guilty as sin, but he got lucky this time around with the jury being absolutely idiotic. They were messing up names of witnesses, asking for testimony from people who didn’t even exist. Just a complete cluster.
