Crimes aren't charged on the end result, they are based on the intent.

Think about the logic of what you are saying...because he wasn't in a coma the charge shouldn't be high? That's the same thing as saying someone that sprayed an ak47, but missed his targets, shouldn't be charged because no one got hurt. Crimes are based on attempt...the fact this kid wasn't more seriously hurt shouldn't matter...

You can cause permanent and fatal damage with repeated blunt trauma like that. Getting stomped in the head is like being hit by a blunt instrument. After losing consciousness? Attempted murder period.
