Aren't "punitive" damages meant to deter the defendant (the game) and others from doing similar behavior again in the future? :
Judge: "Ok Game.... You whooped the shyt out of a known gang member who's named after a fire arm and who has gang injunctions against him and has shot at Police in the past. I cannot stand for any rappers such as 50 cent or others doing this to other rappers in the future. I'll show you mister!"
She only gave him 3k in the main case... By the definition of punitive damages I'd be shocked if he got another damn dime. The judge doesn't give a shyt for him, obviously.
And this situation was once in a lifetime... It's not like a rapper is gonna whoop another rapper ass on Camera tomorrow, like someone will be drunk driving tomorrow (which is why they hand out punitive damages in DUI cases to prevent OTHERS from doing it again).
We'll see what happens.

I am dying at that recollection of events from 40 Glocc, sounds like some bad hood horror movie... and then his assertions that he is living like some sort of wit sec double life, with multiple residences and switching vehicles....

Just pulled the Maryland Pattern Jury Instructions out of curiosity.
Punitive damages have to be proven by clear and convincing evidence (shouldn't be a problem here)
The award should:
- be in an amount that will deter the defendant and others from similar conduct
- Proportionate to the wrongfulness of the Defendant's conduct and Defendant's ability to pay. (this is where it will hurt 40 - the judge didn't buy the PTSD - which means she likely didn't buy that he had guns pointed at him and his life threatened - so how big of a deal is some punches and being thrown in the bushes?)
- But not designed to bankrupt or financially destroy a defendant
