
Are there people arguing that the cop acted in an illegal manner? The cop acted within the law, I don't think any reasonable person would argue against that. Problem was, this is a matter of cop discretion. Was there a point at which she declined the ticket? Technically yes, even though she likely didn't realize her flippant "no" was confirmation of her refusal to sign and that it was a guarantee of jail time (holding) until her signature is obtained.
But, this thread will serve as reference for any future interactions where cops act within the law, but the outcome could have been avoided with cop discretion, I hope to see consistency in the future.
