keep in mind that the movie and book review industry already settled this stuff, and major outlets like IGN dont get messed with not because they have permission, but because they are backed by major media groups.

I dont get the idea behind watching a game on youtube and other people playing it but apparently its young kids that do these days. Instead of buying a game they just watch itit comes down to the question of at what point does it count as 'derivative work'. a video game tends to be more interactive than a movie or music. so just watching it inherently misses a big part of the experience. especially with something like Mario Party

If you do a let's play and don't monetize the video the content ID system will match it and Nintendo will place ads on it and make money on it. In other words Nintendo isn't taking these videos down they just don't want people making money off them unless they go through a Nintendo Partner program where they take upwards of 40-50% of the ad revenue off them.
