Not really.
When you're outside, EVERYONE is a public figure.

I used to work in a camera shop and one of the big things that photographers deal with is this myth that you need people's permission to take their photo in public.
You don't.

Suppose he just took a picture of a man sitting on a bench. Literally nobody would have a problem with it.

But because it's a girl's ass (which, by the way, he was complimenting) it's a problem that needs permission?

I can grant you that it's a matter of taste, but the problem is that it becomes too subjective.
Either we grant that courtesy to everyone or no one. And the fact that no would would question a photo of a man on a bench, means I throw out any consideration at having to ask for permission to take a picture of a girl's ass.
