Nobody should be mad about this.

Some of the most gerrymandered states in the country right now, including Maryland, Illinois, Pennsylvania, New Hampshire, etc. are not subject to preclearing at all, simply because they don't happen to be in the South.

So yeah, I'd say judging states on criteria from 1968 is pretty fukking stupid when clearly the problem is national.

Stupid comparison.

There's an entirely different process to amending the constitution than amending a law. The Voting Rights Act isn't an amendment.

Also, gun ownership is considered a substantive right. Voting is also a substantive right, but this decision has nothing to do with voting per se, so much as the procedure for regulating the manner of voting. The goal of that procedure is to prevent racism in voting, and considering how most of the top gerrymandered states in the nation aren't subject to that procedure, I'd say that it fukking failed.

So I repeat, it's stupid to base preclearing on criteria from 1968. Congress needs to make title 5 apply to the states where preclearing is needed most. Not just southern states. Get me?

i agree with you but legally speaking voting isnt a right, i know it sounds bad but its true, the constitution doesnt say anything about the right to vote

but its treated as a right nowadays and it should be treated that way

The right to vote cannot be abridged solely based on very specific qualifications. That makes it a right in my book.

Marriage isn't mentioned in the Constitution either, but SCOTUS considers it a substantive right.
