Okay, so where are the Jim Crow laws now? Are voting laws in Texas more restrictive than in Kansas? Kansas and Tennessee require PROOF OF CITIZENSHIP to vote. Neither state has to go through preclusion. Tell me how that makes sense. What about all the states north of Virginia with strict voter ID laws? Why do they get a pass?

That's the whole point of the Court's decision -- certain states are being singled out more for racist history than the actual, present-day racism of their voting laws as compared to other states.

The formula was always under-inclusive. It fails, for example, to include such states as Arkansas, Tennessee and Oklahoma, where racial discrimination was no stranger.
