Daniel Penny was acquitted by a Manhattan jury of criminally negligent homicide and second-degree manslaughter charges related to the May 2023 choking death of Jordan Neely on an uptown F train in New York City. The trial, which began in October 2024 and lasted approximately seven weeks, featured testimony from over 40 witnesses, including police officers, bystanders, and medical experts. Penny, a 25-year-old former Marine, was charged with using excessive force during a six-minute chokehold on Neely, who was described by witnesses as acting erratically and shouting on the subway. Prosecutors argued that Penny, trained in martial arts, continued the chokehold long after Neely had stopped resisting and passengers had exited the train, making his actions reckless. They maintained that the cause of death was neck compression from the chokehold, a finding supported by the city's Chief Medical Examiner. The defense, however, portrayed Penny as a hero who intervened to protect other passengers from what they described as a genuine threat, citing Neely's erratic behavior and the absence of weapons found on his person. They also presented testimony from a forensic pathologist who argued that Neely's death resulted from a combination of his schizophrenia, synthetic marijuana use, sickle cell trait, and physical struggle, not the chokehold. Closing arguments were delivered in December 2024, and the jury reached a not guilty verdict on December 9, 2024. The case sparked national debate over public safety, mental health, and the use of force on public transportation.
90 days isn't really enough but I guess the judge knows that sm ban will most definitely have her right back in the joint so it didn't matter how much initial time she got.
