just that smoking in the car during a previous session gives probable cause for a search in the future due to smell..

how would someone argue a smell with a cop? The whole point of telling him this is to get him agitated so that they can find another reason to arrest. There is no point in arguing a smell because you can't prove it either way. Dude did the right thing when he completely ignored it after he already told them he doesn't smoke.
