Bet the judges being unelected wasn't such a big deal when that "Citizens United" decision came out :mjpls:
All the conservatives who are saying this is an example of "legislating from the bench" were big upping SCOTUS after Citizens United. They are so transparently hypocritical.

The 10th Amendment argument is basically conceding that while marriage is fundamental (as has been held by the SC), the definition of marriage should be left to the states. It literally has nothing to do with the argument for or against slavery

I am going to be curious to see how the GOP handles this. Will they take this opportunity to toss the whole gay marriage debate into the bushes and move on or will they decide to keep tilting at windmills and calling for amendments to the Constitution to make gay marriage illegal?

The word "c00n" is losing it's meaning because of how frequently/idiotically it's used on this website. Thomas is basically arguing that the decision should be left to the states, and while I disagree with him, how does that sentiment IN ANY WAY make him a c00n? :snoop:

The latter. It's ingrained in GOP DNA to never acknowledge a loss. They're on Fox News talking about how to file religious discrimination cases due to this ruling.

As long as there's an old white guy in Iowa that thinks god's main concern is gay people kissing, there will be 6 GOP candidates ready to kiss his ass.

What, like the right to marry? Isn't the dissent basically saying that the decision should have been left to the states? When he says the "liberty they sought to protect" what is he referring to other than state's rights/autonomy?

The concept of slavery being legal in a country whose constitution starts with the overarching guideline that "All Men are Created Equally" is a whole separate conversation on absurdity and hypocrisy :mjpls:
