DOJ is subject to use of force policies that HHS is not. Furthermore, based on a lot of reporting, Stephen Miller is ALREADY the de factor 2nd in command in the entire administration. Not a lot of evidence backing your claim that putting immigration enforcement under DOJ will make things worse.

A lot of people seem to forget that ICE has only been around post 9/11, the US managed to do immigration enforcement long before ICE existed. Lotta pearls being clutched for an agency that has been around less than 30 years.
