Got arrested last night, do I have a case?

It's always best to cooperate, especially if you know you have done nothing wrong.


You got to learn how to talk shyt without showing attitude or disrespecting. If they asked what are you doing, you should've just said you're walking.


Like I said before, if they ask for ID give it to them. You don't have to stop smoking or even sweat it, you're in your legal right to smoke cigarettes.


Anyway, they gonna probably try to get you for resisting arrest.. Thing is they have to let you know what you're being arrested for. If they took you in they should've gave you a breathalyzer at the jail, and if you didn't test positive then they would've looked dumb.

And I'm not even sure if under age drinking is even a major crime. Selling to a minor should be worse

Honestly, if you weren't drinking then you should've just took it. But they should've have it to you at some point since that was the original reason for arrest.

But since you resisted they gonna try to get you for that. A lawyer should be able to handle this though, it's all minor and shouldn't be that big of a deal if it's your first offense... But I'm not a lawyer


Your homies should be able to provide statements and be witnesses on your behalf. They should've recorded it

Honestly my bruhs stuck with me till I got thrown in the cop car, but I mean I can only describe the situation in such limited detail. Put it this way, it's my opinion that if either of my buddies started recording and any of the cops saw that they would've grabbed my friends too. Just by the way they were acting towards me/trying to throw me around/slamming my face in the car window, and how they didn't give a fukk about it, they probably wouldn't have given a fukk to have taken one of their phones if they started recording.

First off you were disrespectful. Cops are already a$$holes so what did you think they were gonna do with you talkin shyt? Of course they're gonna find a reason to fukk with you. So then you continue to fukk up by pushing them, etc.

I can't defend the cops but I can't defend sheer stupidity either.

Learn how to deal with the cops. Yes they're your enemy but you must still respect your enemy. Respect the rules of war.

you should of complied to everything they did and then talked as little as possible. only talk when answering questions they ask you.

that way, when they violate your rights and invade your space, you have a solid case cause you complied and they still managed to violate you for no reason.

I asked if I was being arrested, he told me yes, I asked why, he said underage consumption of alcohol

I asked him if he had proof of this, he told me to take a breath-test, told him he had no probable cause, bullshyt like that, I never actually took some kind of test nor do they have evidence or proof that I was drinking alcohol besides him saying to his partner "You smell alcohol on him?"

I'm pickin up what you're putting down though. They were talking crazy shyt to me at the moment, and at the station, and I was talking shyt back. Don't know if they can use that against me though.

Once they say theyre arresting you, legally youre supposed to comply. they prolly will get you for resisting.

I have a family member in a similar situation. he resisted being arrested during a search warrant. he got his ass kicked bad for it too. And hes facing multiple assault charges facing prison time for them fkn him up. ur prolly lucky a similar thing didnt happen to u. if u didnt have wirnesses with u, who knows.

Just by the way you described it, you sounded like you were drunk (or stupid), and yes, refusing a breathalyzer test, and raising arrest are charges. You failed to mention before any of this (until vaguely, later in the story) that you were actually drinking beforehand, not just "walking with cigarettes", and vaguely alluded to the fact that smoking a cigarette could cover your alcohol breath.


No offense, but most people, even SLIGHTLY buzzed people, greatly underestimate how strongly of alcohol they can reek. Sounds like the cops were dikks, but you reacted foolishly insured of keeping your cool, even that was in your best interest. Now you're cased up, asking the Coli to trust your inebriated play by play, and give you help.
