I can't front.......it certainly is. :manny:

I also found that honesty just seemed to work better on cops for me. Telling them 'I was drinking, but I stopped a few hours ago, knowing I was gonna have to drive home and I thought I was OK." That shyt seemed to go along way.
:ohhh:i got pulled over for passing a cop while we were going the speed limit.:birdman: I want some white privilege:feedme:

I've had a situation like that happen where I was out drinking and got caught up with the cops and obviously due to the liquor I needed to use the bathroom (before and while I was in custody). they were not tryna hear it and finally after about 45 mins parked in some waiting area of a police station I finagled my zipper down, with my cuffs on, and twisted my body so I could piss on the part of the seat farthest from me in the backseat of the cop car, shyt was houdini like. thinking back I'm glad that they didn't whip my ass for that but all I could think the whole time is "these a$$holes really are tryna have me out here pissing on myself".

moral of the story: these cops will try to make sure you end up pissing on yourself.

Detroit Pistons' forward Greg Monroe, who is facing a two-game suspension after NBA officials learned he pleaded guilty to impaired driving in April, "urinated on himself during the booking process," the Huntington Woods police report documenting his arrest says.

:ohhh:

And while I'm here... immediately plead the 5th. Don't consent to any searches. Refer matters to your attorney. Crack the window. Don't make eye contact with officers because they will accuse you of looking drunk, even if you're stone cold sober. Refuse the breathalyzer and field sobriety tests.

Where are you getting this info from.

1. Crack the window? LMFAO - if they tell you to get out the car, you HAVE to get out the car. If they pulled you over suspecting you of being drunk, they aren't going to speak to you through a cracked window.

2. You don't have to make eye contact with them if they already assumed you're drunk, they will accuse you anyway - you didn't make any sense here.

3. Refuse the breathalyzer and field sobriety tests - well prepare to go to jail and this will be used against you in a court of law. Additionally, your license will automatically be suspended because you agreed to do these when you attained your license.

When have you heard of someone getting out of a DUI conviction by not taking a breathalyzer or field sobriety test?

My coworker got pulled over for something stupid( tinted windows or something like that) and was accused of being drunk. He had been drinking so he stalled as much as he could and demanded a blood test with an attorney present. I don't think he was able to get an attorney but due to traffic and stalling, it was an hour later when the blood was finally drawn and his BAC was below .08. They didn't charge him with anything because the case was too weak.

I think these days they test multiple times and try to graph your BAC so it may not work anymore.

:what:

1. I didn't say you didn't have to get out of the vehicle. You crack the window because not everyone who is pulled over is done so under suspicion of DUI and you don't want to give an officer an excuse to accuse you of DUI by claiming, real or not, they smell alcohol. All they need to do is claim they smell alcohol and cowardly rat fukks like you start squealing that you just had 1 at dinner... or maybe 2... well, maybe 6. Much harder to do with a cracked window.

2. See Point #1 about not everyone being pulled over on suspicion of DUI. My advice especially applies to DUI checkpoints.

3. Oh, so I guess if you take the Breathalyzer and complete the field sobriety tests, you won't be going to jail? :pachaha:But go ahead dipshyt, hand the case to the prosecutor.

People refuse these tests every day and overturn the license suspensions. A quick Google search could tell you that...

http://www.delsignoredefense.com/dui-case-results.html

EXAMPLES
2-24-14: Client had license reinstated after an Appeal of a Breath Test refusal suspension. The client avoided a three year license loss after Attorney DelSignore persuaded the RMV to overturn the suspension.

7-26-13: Attorney DelSignore appealed six month breath test refusal suspension; after the suspension was affirmed by the RMV, the district court reversed the decision of the RMV suspending my client's license for breath test refusal. Client was able to obtain IMMEDIATE REINSTATEMENT OF LICENSE.

I have heard of people getting out of DUI convictions every day by not HANDING OVER EVIDENCE. Hell, even people who fail the breath test and field sobriety tests can get the convictions overturned with a good attorney.

You don't know shyt about the law.

Imma keep it short but sweet, because you're talking bullshyt.

1. Crack your window will mostly infuriate the cop - depending on what he pulled you over for. Try talking to an officer through a cracked window, especially if he can see you. And you also said to avoid eye contact, which is only agitating the cop even more. This step is logical if it's Barney Fife but a real aggressive cop is only going escalate the situation if you do this.

2. DUI check points they will tell you to get out the car, especially if you try this in most cases - they are actively looking for intoxicated drivers who try to play it off.

3. Without seeing the circumstances of the case you could post a bunch of b.s. of people getting off. LOL@ you posting something from a laywers website , of course they going to make it seem like they are super lawyer. Plus every state is different, so I won't try to get into a tit for tat battle, you're speaking in general and the conviction rates in alot of states are incredibly high with or without breahalyzers.

Now what you don't state, is that if you aren't drunk and you refuse, you automatically lose your license privledge and you will be going to jail, which is the point I'm making.

While your other 2 points are B.S. , I will agree that if you are legitimately drunk there's no point in taking the breath or sobriety tests. But you better hope and pray for a miracle because despite your little anecdotes from that law firm, the percentages of those who get off are quite low in some states.

You posting this crap like it's the cure to cancer - giving out poor information

I refused to take a breathalyzer once, they didn't arrest me. Why's that?

fukk you asking me for...go ask the cop

seriously, go look at your state law....bet you could have gotten arrested and your license suspended up to a year just for refusing. However, if you're speeding down the road and you get stopped by a cop and he lets you off - does that mean that you're always going to get off or that the next guy is going to get off. I already admitted above there will be some instances where you may play this card and get off , but a good amount of people will not.

but that cracked window and don't look into his eye crap will get you hemmed up and if you aren't drunk, you should not deny the breathalyzer or field sobriety test, cuz you're only causing yourself more potential hardship. People don't realize that not taking a breathalyzer is a punishable offense in most (if not all) states

I'm not joking when I say this. . . start with the Constitution. 1st, 4th and 5th are your big friends. Then start Googling Supreme Court cases related to those amendments to see more specific applications of the law.

I love this video too...

nevermind

Under "implied consent" laws in all states, when they apply for a driver's license, motorists give consent to field sobriety tests and chemical tests to determine impairment. Should a driver refuse to submit to testing when an officer has reasonable suspicion that the driver is under the influence, the driver risks automatic license suspension along with possible further penalties.

Consequences for breathalyzer refusal vary by state, which may explain the wide variance in statewide refusal rates, but most states impose an automatic six- or 12-month driver's license suspension upon refusal of a BAC test. Suspensions usually increase for a refusing motorist with past DUI convictions, sometimes including jail time. License suspension following a refusal may also cause your car insurance company to cancel your policy. In many states, if the driver is found guilty of DUI, having refused the breathalyzer can result in enhanced penalties.

it's always funny when people would rather argue and tell you you're wrong, instead of doing the extra due diligence to look something up..smh
