1. I didn't say you didn't have to get out of the vehicle. You crack the window because not everyone who is pulled over is done so under suspicion of DUI and you don't want to give an officer an excuse to accuse you of DUI by claiming, real or not, they smell alcohol. All they need to do is claim they smell alcohol and cowardly rat fukks like you start squealing that you just had 1 at dinner... or maybe 2... well, maybe 6. Much harder to do with a cracked window.
2. See Point #1 about not everyone being pulled over on suspicion of DUI. My advice especially applies to DUI checkpoints.
3. Oh, so I guess if you take the Breathalyzer and complete the field sobriety tests, you won't be going to jail?

People refuse these tests every day and overturn the license suspensions. A quick Google search could tell you that...

2-24-14: Client had license reinstated after an Appeal of a Breath Test refusal suspension. The client avoided a three year license loss after Attorney DelSignore persuaded the RMV to overturn the suspension.
7-26-13: Attorney DelSignore appealed six month breath test refusal suspension; after the suspension was affirmed by the RMV, the district court reversed the decision of the RMV suspending my client's license for breath test refusal. Client was able to obtain IMMEDIATE REINSTATEMENT OF LICENSE.
I have heard of people getting out of DUI convictions every day by not HANDING OVER EVIDENCE. Hell, even people who fail the breath test and field sobriety tests can get the convictions overturned with a good attorney.
