The league doesn’t have the power to suspend or fire him, which is why they’re nudging the Raiders to do it.
The league does have the power, but they don’t want to be on the hook for setting the precedent of discipling someone for private communication that took place a decade ago. Clearly people are ok with this type of talk - ie the recipients - as no one made anything of it years ago. This talk is commonplace behind doors, if the NFL goes after him, they effectively have to go after anyone whose conversations leak

He was not an employee of the NFL during the time that those email communications took place, so they don't have the power or authority to suspend him for it. It would have been an ESPN problem and not the NFL if he was still working for them.
