will actually fight in your favor as a black male in court?
I keep hearing of and witnessing these people aiming for these so called black males to plead guilty no matter the circumstance. The magistrate reads off of a list and bam, it's done, until a return for sentancing.
How much?
True talk...
The law is a numbers game thats all it is...
The police are not interested in whether you are innocent all guilty, its all about whether they can get a conviction.... for example If you and three of your dudes are driving and you get stopped by police and they find an unlicensed weapon all they gonna tell you is "someone gotta eat the charge for the gun" they dont care whose it is, whether the person is innocent or guilty...... If police dont have enough evidence to make a case stick even If they know youre guilty as hell you will walk....... by the same token If they can stick a charge on you and they know damn well you are innocent your ass is going to jail....
dumbest thing you can do is talk to police during an interview .... correction.....dumbest thing you can do is talk without a lawyer present, and even If a lawyer is present most of the time he will advise you to keep silent.....
reason being unlike the bullshyt you see on TV the questions arent designed to elicit information, they are designed to trip you up
cops arent going to ask you questions that they dont know the answers to, they are going to ask the questions they know the answers to, hoping that you might trip up
9 times out of 10 the questions arent relevant, and thats when a good lawyer will step in...
for example the cops might know for a fact that you were at your girls house on wednesday between 7 and 10, it might not even be relevant to your case
they dont say "we know you were at your girls house between 7 and 10" .... what they say is " where were you between 7 and 10 on wednesday?"
now you might have forgotten and say 'i was at home, or you might even lie saying you were somewhere else..... like I said it could be a pretty innocuous question.....
fast forward to your trial prosecutor says to the court why did you lie to police about your whereabouts between 7 and 10 on wednesday? ...
like I said it may have nothing to do with the case, but now the prosecutor has shown the jury that you are a liar .... in the minds of the average juror innocent people dont lie to the police, If you had nothing to hide why lie?
its a well used tactic...
thing about having a good lawyer is this.... first thing they are going to do is look over the paperwork.... police are notoriously sloppy, If procedure hasnt been followed, a name miss spelled trust me, they will get that shyt thrown out on a technicality .... a good lawyer will stop you from answering bullshyt questions during an interview.....
a lot of the time as well as long as its not a major major case once the prosecutor sees you are lawyered up rather than incur the cost of a lengthy trial which will cost the state money and one which they could lose they will hash out a deal with your lawyer that is favourable to YOU ....
its just a numbers game
other people on the board probably have different experiences obviously but for me thats what i learnt about the system
