Seriously you should say no. I do payroll as part of my job and anybody who does payroll knows that if they screw up that's their bad they got to take that L. Basically you should tell them that you looked up your state laws and that you are legally entitled to the money. They cannot use it against you either because you could sue them and that's a lawsuit that you would win. So you got them by the balls. It's yours you spend it.

Edit: I should add one caveat. If you work for a non-profit then it's a bit of a different story and maybe you should give the money back cuz they ain't ballin' like like that. But if it's a corporation then they lawst
