So back in September 2014, I got into a car crash. I was at fault and didn't have insurance at the time. I know I would be liable for the damages, blah, blah.
So went to the DMV because my license got suspended over it. They wanted me to pay $2200 + $250 reinstation fee :stopitslime: or they told me wait a year from the date of my suspension and they will close the case and at that point, I would just pay $250 reinstation fee. So I waited the year.

Now from November 2014 on, I've been getting collection calls representing the insurance company of the person who hit me. But when I spoke to the DMV, they told me an attorney from said insurance company will be contacting me. From there I could settle, set up payment arrangements, etc. But I never got contacted by one. Only by that collection agency.
So, last month I got my free annual credit report and on my Equifax, I saw a soft pull from that insurance company. I'm confused at this point. How the hell did they get my social to pull my credit?:dwillhuh: and it was obviously pulled without my authorization.
I haven't heard from that collection agency since Feb. 2015. A few weeks ago, I was contacted by another collection agency representing the insurance company but I'm dodging their calls. I'm pissed about that credit pull, that got to be something they can't do without my authorization right? I don't know what to do from this point :snoop:

Time to consult and attorney and see if you can turn this L into a W. Apparently there are a lot of cases where you can get debt collectors for doing dumb shyt, but most people
don't know their rights. Look up some laws about the shyt and consult someone with legal knowledge and just find out what can be done.

Nobody wants to pay 3rd party collectors, so you might as well find out if its possible to at the very least put them in a disadvantaged position.

But the problem isn't the collection agency, it's the insurance company that pulled my credit. It's them that sold the debt to collections. Wouldn't I need to go after the insurance company?

No, cause you did owe them. Depending on your state, it may be perfectly ok for them to pull your credit. Just look into that and see if you have a case.

Usually when companies sell of debts, they aren't looking to collect it anymore, and your beef transfers with the third party, so only the collections should be calling you about payment.
Obviously the pull itself is a different matter, but again, just look into your state laws and see if they were good to pull your credit. It might even be in a clause somewhere that you
signed, who knows.

When you stop getting notifications, that's when collection agencies doing they work, which is usually them two piecing that credit line of yours. And them selling the debt to shady ass third party collectors is fairly common.

I didn't sign anything though, that's the problem. The accident happened when I was living in Florida at the time.

Best thing you can do is take the L you rightfully deserved, pay what you owe and keep it pushing. Debt is like murder...it never goes away (unless you file bankruptcy). All collection agencies do is buy that debt for pennies on the dollar, add their fees, see if they can collect. If so, cool..if not, sell it to another agency and the cycle keeps going. Maybe you'll be lucky enough to catch an agency violating fdcpa, but outside of that you don't have any recourse. You have to look at your credit score in the grand scheme of things. Not to mention, stuff like that will fukk up your insurance premiums also (they check credit also). They don't need your authorization, it's already proven you owe a debt and they'll do everything in their ability (within the law) to make you pay it.

I worked for a collection agency years ago briefly and :wow:, just be glad it's something small. I used to see people begging supervisors to put court papers on folks so they could get that ball rolling to try to get that commission. Others will get nasty and report on your credit every month just to get you fukked up because they know you won't pay. But sooner or later, they know you're gonna have to talk to them. When you consider a home, a car or something like that, you'll end up paying more than 2k when they hit you with higher rates because they kept reporting each month.
