If he were to declare war, war comes with casualties. Soldiers would die, citizens would die. Since there's no declaration, he can just kill or bomb or threaten whomever he wants and if anyone decides to strike back well America is the victim and they were wrong for attacking or threatening because there's no declaration of war. When America does it, it's right, anyone who does it to America is wrong. Think Israel.
