I’m being sued by a former employee.. can I counter sue for slander?

Long story short

He was a manager and I was the area manager so he reported directly to me. He was fired by my boss who was the regional vp.

He had been with the company 12 years and when he got fired I had only been with the company 4 months. My boss actually decided to fire him and he wanted me to be there as a witness and to conduct transitional work with the manager stepping into the role temporarily.

But the manager wasn’t there and my boss couldn’t wait so he gave me the letter and asked me to explain shyt.


This was December 2021. He’s suing the company for racial discrimination and he’s suing me because I’m the one that fired him. All of the discrimination claims took place years before I even worked there.

The company is paying for my legal fees, but this is bullshyt. I gotta do a deposition and possibly go to a trial. He’s Haitian and I’m a black with an Arabic name. When I told the attorney that she laughed. He was one of 6 managers that reported to me. One was Nigerian, another was from Guyana, another was from Jamaica and another was fukking Dominican. In fact only one manager was white.

Can I counter sue for slander? :what:

What exactly is he suing you for?

He’s basically accusing me of lying about why he was being fired. But I didn’t. My boss at the time did, and he even spoke with him after the fact.

He had beef with another supervisor who was Dominican. But he didn’t work with him when he got fired and had nothing to do with it either. My role in this is zero. Dragging me in it is bullshyt.

are you seriously going to post this on a public message board instead of seeking legit and professional legal advice?
I meet with my lawyer next week. The company is paying for it.

If I try to sue, I doubt they gonna pay for that so I’m asking if it’s worth pursuing. There’s a lot of old ass people on this site. Somebody is bound to have an answer.

A deposition? If the EEOC took his case, which has to happen before you can sue your employer, mediation will be the first step. If the employer denies that, then they just have to send over their evidence. 99.9% chance the case ends up getting settled or thrown out at that point. Going to trial is super rare

No breh, you cannot sue for slander. Slander requires 2 main provable offenses

1. It must be proven it is not only a falsehood, but that the individual doing it KNOWS it is a falsehood
2. You must be able to show how the falsehood has done significant damage to your way of living
1. I can’t prove it
2. I’m emotionally distraught and embarrassed. I use a P.O. Box for everything including my drivers license so how the fukk did I get served papers in the first place? Now I’m paranoid whenever I got out. Pain and suffering.

Real shyt, you should probably hit up a lawyer. Anytime I've seen* ppl bring up slander they say it's hard as hell to prove. You gotta prove so much shyt, like how it affected you and stuff. Sounds like you wouldnt really have a case anyway. Although you werent part of the discrimination, you were acting on behalf of the company when you fired him. :manny:

Defamation would fall under the slander stuff, well slander/libel would fall under the defamation umbrella. You would have to prove what damages that person caused you. I think it also has to be stuff like the person goin on social media calling you out and stuff as well, not just because he named you in a lawsuit.
Like if someone said I was a thief with no proof, and my job fired me for that or I lost opportunities for that accusation, I could sue for defamation.
