During oral arguments in a pivotal affirmative action case on Wednesday morning, Supreme Court Justice Antonin Scalia raised the suggestion that African American students might belong at less rigorous schools than their white peers and that perhaps the University of Texas should have fewer black students in its ranks.

Scalia's comments came during arguments in Fisher v. University of Texas, a case over whether the university's use of race in a sliver of its admissions decisions is constitutional. The University of Texas at Austin is being challenged over its use of race in admissions decisions for about 25 percent of its freshman class. About 75 percent of the students at UT-Austin are admitted through what's known as the Top Ten Percent program, in which any student graduating within the top 10 percent of his or her class is guaranteed admission, regardless of race. The other 25 percent are admitted via a "holistic" process that takes race, and other factors, into account. It's the "holistic" program that Abigail Fisher—who was denied admission for the university in 2008—is challenging.

The University of Texas has determined that if it excluded race as a factor, that remaining 25 percent would be almost entirely white. During the oral arguments, former US Solicitor General Greg Garre, who is representing the university, was explaining this to the justices. At that point, Scalia jumped in, questioning whether increasing the number of African Americans at the flagship university in Austin was in the black students' best interests. He said:

There are those who contend that it does not benefit African Americans to get them into the University of Texas where they do not do well, as opposed to having them go to a less-advanced school, a slower-track school where they do well. One of the briefs pointed out that most of the black scientists in this country don't come from schools like the University of Texas. They come from lesser schools where they do not feel that they're being pushed ahead in classes that are too fast for them.

He went on to say, "I'm just not impressed by the fact the University of Texas may have fewer [blacks]. Maybe it ought to have fewer. I don't think it stands to reason that it's a good thing for the University of Texas to admit as many blacks as possible."

After a comment like this, Court watchers will really be looking forward to his opinion in the case.

There is nothing worse than someone being right for the wrong reason.

Affirmative action was used to destroy the confidence of black kids who would be 3.5-4.0 at their state school who are 2.0-3.0 at MIT. The top black kids arent hurt, but the 70-90th percentile are.

If your SAT is below a certain number you probably cant compete on curve with people a deviation above you. Thats why they use AA to admit black kids who had good grades and low SAT(over achievers) into schools they wont succeed in. Then, if your SAT was high and grades were low(smart, but probably had family reasons for poor h.s. performance) youre stuck at the state school with all the dumb cacs.

They use AA to make sure we dont go to schools that are a good fit.
This... doesn't sound right at all.

Also, to this day, white women have benefited more from AA than any other group BY FAR. I only think that AA is even a focus of discussion when its about shytting on black people tbh.

Yea, its easier with example.

black kid with 3.8 gpa and 1800 SAT goes somewhere where the average SAT is 2200. He will get destroyed by the bell curve. Has nothing to do with race. Black kids get 2400 too. So now, this kid is in his second semester at MIT with a low GPA. He now leaves the computer science major to switch to sociology, where he curve doe not kill him, loses confidence, drops out, whatever.

Send the same kid to a state school with an 1800 average SAT. His work ethic helps him succeed, and is actually noticed. He can get research opportunities(everyone goes for them at the top school) because people will actually apreciate a hard worker. He finished the first semester with a 3.5, and has developed his study skills. Hes confident, and goes on to get a degree in computer engineering.

The 3.8 gpa 1800 SAT kid fails out of MIT and graduates with honors from UAlbany.

Second black kid. 2200 SAT from a shytty family. 3.0 gpa in high school with barely 50 percent attendance. The top schools will label him lazy. He will go to a state school and be surrounded by people far below his ability level. This could lead to a lot of different outcomes, but in the end he should be at a top school if not for family circumstance. IMO this should be the point of AA.

The first example is a phenomena Malcolm Gladwell and Thomas Sowell have written about. "Outliers" by Gladwell. And I dont remember which Sowell interview, in the interview he points out how the average black kid at MIT is in the top ten percent in Math in the country, but bottom ten percent in math at MIT.

The second one is basically my story/ anecdotal/ venting.

I don't 100% agree, but I see where you're going. Thanks for the response though.

What dont you agree with in particular? I dont really have a postion, I just believe the implementation of Affirmative action hurts black students. Im only talking about in college admissions. Did you study STEM in college? No shade, but the curve is something you have to experience yourself.

Listen man this is all bullshyt. We need to get as many AA in these schools as possible. Not cause they have better curriculum (who the fukk goes to uni of Texas to become a phD in the first place) but because these are where all the connections to get a job are at. A lot of these students are at these high power schools because someone made a phone call
