that was one of the cases that changed the game.
Since then music coming out of major's gets tripled checked before its released.
some producers try to sneak samples on by changing them a lot. i remember puffy lost a court battle over a sample for ready to die which was settled 10 years after it was released

hard to believe that Ye/Def Jam wouldn't clear such a blatant sample considering that he's rapping over a loop. I wonder if the original singer doesnt own the rights to his song, doesnt realize it and is trying to cash out while Def Jam dealt directly with the catalog that this song is in.


that's probably what happended...dude more than likley signed one of those Frankie Lymon deals :yeshrug:

When has any of these sample clearance lawsuits ever came in favor of the plaintiff?

-Steely Dan won their case against Lord Tariq and Peter Gunz for the sample in Deja Vu (6 figures and 100% Pub) They also won their lawsuit against De La Soul for "Eye Know"

-The Beatnuts reached a settlement against the Trackmasters when they jacked the beat for "Jenny from the Block".

- Pharoahe Monch lost a suit for sampling Akira Ifukube's "Gojira Tai Mosura" on "Simon Says"

-Teddy Riley lost for sampling Lyn Collins' "Think (About It)" on Rob Base & DJ EZ Rock's "It Takes Two"

-Bad Boy Entertainment and Universal Records were ordered to pay a total of $4.2 million in damages to Bridgeport Music and Westbound Records for sampling Ohio Players' "Singing In The Morning" on The Notorious B.I.G.'s "Ready to Die"

-And the Biggest of all Was Biz Markie sampling Gilbert O'Sullivan's "Alone Again". The Judge in the case even pressed for criminal charges against Biz. Biz's album I Need A Haircut had to be recalled but was later re-released without "Alone Again". Biz wound up calling his next album All Samples Cleared.

You gotta be an idiot if you think Ye didn't clear that sample, but it does give a middle finger to the original calling it "Bound 2" and funnier if he didn't clear it on purpose, kind of like stealing candy from a kid :russ:
