one thing i wonder. kid was discovered in an orphan so he didn't have parents to sign contracts for him. can the orphanage (who i guess would be his legal guardian in this case) decide for him that it's best to leave the publishing/masters/royalties and all that to the record label? let's say the court rules that there was some sort of conflict of interest when that original contract was signed, does that mean that kid now owns it all? :ohhh:

Chuck Brown, Sr. of Chuck Brown Music owns the "Bound" song under his publishing and has said that he doesn't mind Kanye using the record. Brown said he isn’t also looking for a fight because U.S. copyright laws are relatively straightforward. He hopes West sells a billion copies of his new hit CD while ownership and rights are being verified.

The original sounds like they were tapping into The Jackson 5 sound at that time, dude even sounds like a little Michael Jackson. But the original song is Classic but there's no way KanYe didn't get it cleared with someone. The sample is way to noticeable, it's not like he took a small part. The Main loop is dudes and the groups voices. But it's such a beautiful record. Glad Ye' put me on. Best song on "Yeezus". This is what's so great about Hip Hop, sampling is the blood line of the music so discovering a great song from the sample makes it twice as great. That's why I loved that he called it "Bound 2" cause it had like a double meaning, it's the sequel to the original but it's also talking about the love of his life.

He cleared the sample, the writers of the song are credited on yeezus. This nikka has no writing credit so he's salty that he didnt get a penny.

sounds like he may have cleared it - the problem is the group has 2 members in jail allegedly for life and Ricky has power of attorney, so he probably is suing Kanye without knowing that he doesn't own the rights.

and according to articles

It's likely that West believed he had legally acquired the rights to the song through All Platinum Records, but Chuck Brown Sr., who ran the Ponderosa Twins Plus One's record label, insists that the publishing rights to the song remain his, according to The Cleveland Challenger. Spicer also says in the suit that he has a copyright to the recording.

hard to believe that Ye/Def Jam wouldn't clear such a blatant sample considering that he's rapping over a loop. I wonder if the original singer doesnt own the rights to his song, doesnt realize it and is trying to cash out while Def Jam dealt directly with the catalog that this song is in.

I agree

according to the link I posted, the original owner was Chuck Brown under Horoscope records

but according 2 what happened Ye cleared it through Rhino records through All Platinum REcords and Aroscope records , who claim to have ownership of the song

the song was written by the OJays

the singer doesn't seem to have any rights to the songs at all - not enough to sue Kanye - this will be thrown out. But what it did do was get himself some attention and the original song the attention it deserves...I never ehard this song before and it sounds GREAT.
