I doubt that's a good enough defense in New York. In many other states you would be absolutely correct.
That's what the police are for. They do evictions every day. He's too old to be doing shyt like that. Idk the whole situation but the tenant seems to be in the right.
Go to jail the rest of your life rent free brehs 
New York tenant laws are pretty wild. If you’re trying to evict someone, it could take like a year to finally get them out.
