I think i was wrong on the concurrent sentencing. Apparently each attempted murder count carriers a minumum 20 year sentence in florida.

Was the jury instructed to consider second degree or manslaughter though?

First degree murder is a guy takes out an insurance policy on his wife then kills her for the money or he catches her cheating and plots out a plan to kill her and her lover.

The DA/prosecutor in Florida is a joke they keep overcharging there was no way they could get first degree murder. 2nd degree or manslaughter would have been easier to prove to the jury of course they CONSIDERED it but the jury had first degree in their minds so it was gonna be hard to get them to convict him of something lesser when you made a case for first degree.

1st degree could also be someone getting upset, taking a gun out their glove compartment and taking the safety off
that's not premeditated. premeditated means you thought out or planned the killing in advanced to doing it. this situation was a random on the spot murder that wasn't planned out.

I'm saying first degree murder should ALWAYS include the lesser forms of murder.

But to answer your question, yes this jury was instructed to consider second degree murder and manslaughter


Earlier in the day, the panel said in a note to Judge Russell L. Healey that they couldn't agree on the murder charge. They also had the option of convicting him of second-degree murder or manslaughter. The judge asked them to continue their work, and they went back to the deliberation room for two more hours before returning with a verdict.

Them being able to reach a consensus on the attempted murder charges but not the murder charges makes absolutely no sense :mindblown:

Argue all you want about how they actually prosecuted the case but they did not overcharge

That is not true

The need for deliberation and premeditation does not mean that the perpetrator must contemplate at length or plan far ahead of the murder.
Time enough to form the conscious intent to kill and then act on it after enough time for a reasonable person to second guess the decision typically suffices.

Dunn did not randomly decide to kill Davis, he pulled his gun from the glove box, loaded it, and aimed it with intent to kill

Yet they did exactly that with the attempted murder charges.


Stop making excuses for this jury.

Damn.. so the jurors made sure Michael Dunn isnt walking... but by avoiding the murder charge theyre validating his credibility. Cause the verdict stands on the assumption that Jordan Davis may or may not have had a weapon.

All Michael Dunn had to rely on was his word and by extension his character. the latter got assassinated in that interview with his former neighbor.
But somehow his word is still enough to leave a shadow of doubt :stopitslime:

Dude really said "he pulled out a gun or a stick" though :dahell:

You should give a fukk you simple minded nikka. If not for the fact that he didn't kill the other 3 passengers he would have gotten away with killing Jordan Davis.


the laws are too messed up........it should be if you kill someone, then you get automatic time in prison, no matter what........That would stop a lot of this improper weapon handling that goes on............and make people respect life more than they do now.
