update - so my legal breh said to get second degree, you have to prove intent.m, which again, you need to prove without a doubt to a jury that’s likely gonna be majority white (Minnesota).

when it comes to murders, it’s all about the level of culpability of the murderer - what was their mind state going in. Third degree indicates a “depraved state of mind” where his actions knew he could lead to a death, but there wasn’t intent to kill specifically.
