I'm in a union and far too many people think it makes you bullet proof. It doesn't. He hasn't described why he is missing work for you to conclude that the union should be on his side.

I don't wanna get too crazy but its alot..but my sister has probably almost died at least 10 times in the last 4 months... and out of those 10, 4 were in the same day. Ive asked to change shifts to accommodate hospital stays and they refuse to move me. Alot of shyt goes down in hospitals mid afternoon/evening/night... I start work at 7:30pm.. if there's a situation and she can't speak for herself im not leaving until shyt is straight.

Do not sign it.

Do not trust managers.

Always have a union rep. You pay union dues for these situations.

If they suspend or fire you, you will be paid in full and/or get your job back. You might be able to sue for wrongful dismissal if it even goes that far.

I have seen this shyt happen countless times. I have also been part of three unions.

yeah that's tough you gonna just have to keep all your records so they don't fire you with a false reason.

Yeah I feel for you bro. Really do. I hope she gets better soon. But jobs don’t really care unless it’s you, your spouse or children unfortunately . You might be screwed. Hope not tho

Are you her guardian? If not you’re likely choosing your sisters well being over your job which is the thing to do imo.

I would definitely support one of my employees in a situation like that but I only have 4 in my IT department.

What’s your company’s attendance policy?

You’ve depleted all of your sick/vacation days?

Are you on a point system or hours being deducted from a “bank”?

Typically a write up comes as a notification that you’re running low on available time off. You don’t have to sign it and if your union rep isn’t available at the time it was issued then it’s definitely a refusal to sign.

Sounds like you expect your employer to accommodate your off the clock issues & quite frankly, they don’t have to.

It’s up to you to have your issues under control enough to get to work on time.

I’ve seen people get fired due to a not getting fmla to take care of sick family members and not having babysitters.

What precedent has been set by your employer in regards to discipline for attendance with previous associates? Are they known to terminate due to poor attendance?

This may sound cold but its true. Its a business. If you cant make it to work reliably then they will probably start making steps to get you up out of the paint so they can get somebody else in there who can.

Its not personal.

I requested a union representative be present before I sign anything and then they spent the next 10min trying to intimidate me into signing still. Then I requested a rep again and I was accused of refusing to sign the write up. I've never really been in one of these situations because I come to work and do my job and don't cause problems. They are trying to hem me up due to an ongoing personal family issue (my attendance has been shotty the last 4 months and I used up all of my sick days and fmla doesn't cover the particular situation im in). I feel like they are in the wrong the way they approached me and tried to press me. Is this grounds for getting the write up nullified or nah?

nikka do you work for the post office? :russ:

He ain’t getting fired, epecially with carrier attrition
If he does, they need a paper trail for attendance
And most companies don’t keep that anyway
So it’s easy to fight, especially with the PO
If they didn’t start with an Investigative/PDI
He’s still gucci but even still
The supervisors/management denying union representation can back fire and lead to a whole other can of worms
That’s the easiest way to win a grievance and even if it’s an at will state
It opens the lane for a lawsuit if they fire him without following proper protocol
On at the very least a complaint to Dept. of Labor
And at this point, a lot of management is using this shyt as scare tactics
Knowing damn well ain’t nobody coming through them doors to do any of these jobs at the moment
My advice is read your contract/employee manual/union book and find out the policy on attendance
Get off the damn coli and contact your union rep asap
Yeah they can try to snake you with failure to follow instruction
But if you have a competent union rep
They can get that shyt tossed into the bushes with ease or bare minimum, get the discipline knocked down to a lesser “charge” for the lack of a better term
Just know that win, loss or draw on a grievance
Management about to be on your ass and will definitely find a way to get you out the paint off pure pettiness
